Access to public information

Law 19/2013, of December 9, on transparency, access to public information and good governance 

Purpose of the procedure

This procedure aims to exercise the right of access to public information of the UNED Associated Center in Pontevedra. Public information is understood to be the contents or documents, whatever their format or medium, that are in the possession of the Associated Center and that have been prepared or acquired in the exercise of their functions.

All information that is already published on the Center's website and its transparency portal should not be requested. 

Requests for information about academic activity (studies, exams, validations, etc.) will be directed to the email  secretaria@pontevedra.uned.es

Recipients

All people may exercise their right of access to information, in the terms provided for in article 105.b of the Spanish Constitution.

Presentation media

By email through a signed request with a digital certificate. 

In person, by completing the form found on the transparency portal of the UNED Associated Center in Pontevedra and presenting it at any of the places established in article 16.4 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Submission deadline 

Whenever.

Required documentation.

The application form duly completed and signed.

Express written consent of the affected party when the request for access to public information contains personal data of third parties unless a law authorizes access.

Motivation

In principle, there is no obligation to justify the request for access to public information. However, the interested person may state the reasons why they request the information, which may be taken into account when the resolution is issued.

Requests must be motivated when, in the exercise of a right or for research reasons, access to personal data that is not especially protected is requested.

Maximum resolution period.

One month from receipt of the request in the Center's registry, which may be extended for another month in the event that the volume or complexity of the information requested makes it necessary.

Formalization of access.

Access to information will preferably be done electronically, unless it is not possible.

When access cannot be given at the time of notification of the resolution, this will be granted within a period of no more than ten days.

If there has been opposition from a third party, access will only take place when, having granted such access, the period for filing a contentious-administrative appeal has elapsed without it having been formalized or resolved confirming the right to receive the information.

Effect of administrative silence

Dismissal.

Resources

Against any express or presumed resolution regarding access, a claim may be filed before the Transparency and Good Governance Council, on an optional basis and prior to its challenge through contentious-administrative proceedings.

The claim will be filed within a period of one month from the day following the day of notification of the contested act or from the day following the day on which the effects of the administrative silence occur.

The resolutions issued regarding access to public information can be appealed directly before the Contentious-Administrative Jurisdiction, within a period of two months counted from the day following the day of notification. In the case of lack of notification, the period will be six months from the day after the alleged act occurs.

Personal data protection

In accordance with the provisions of EU Regulation 679/2016 General Data Protection and current legislation, we inform you that the data provided in this document will be processed, as Data Controller, by the UNED Associated Center in Pontevedra.

The purpose of data processing is the management of this procedure.

The legal basis by which your data is processed is compliance with the functions included in the aforementioned regulations, and, where applicable, consent. Likewise, the data will be used to send information, by any means, about the purposes described above.

Your data will not be transferred or communicated to third parties, except in the cases necessary for the due attention, development, control and fulfillment of the expressed purposes, as well as in the cases provided for, according to Law.
